Las siguientes condiciones son hechas y acordadas entre el remitente y PAQUETES Y CARGA EXPRESS LTDA, Referido como PAQ.

1. PAQ, sujeto al servicio prestado y previo el pago según las tarifas establecidas, transporta a su destino el envío, sujeto a las condiciones descritas en la respectiva guía. PAQ se reserva el derecho de usar cualquier ruta y proceso que crean necesario para completar el despacho.

2. PAQ, tiene el derecho de rechazar o rehusar cualquier paquete, ya sea después de haber sido aceptado a su discreción. Seguros negociables, materiales peligrosos, efectivo y objetos que no sean aceptables para transporte aéreo no fueran aceptados por ninguna circunstancia.

3. El remitente declara que los contenidos de sus paquetes no incluye ninguno de los artículos mencionados en el párrafo número 2, ni tampoco contiene artículos prohibidos por la ley de cualquier estado o ciudad en la cual el paquete llegue o vaya . Cualquier oficial del gobierno y/o algún representante de PAQ , puede abrir o inspeccionar el cargamento.

4. Entre el remitente y PAQ, se acuerda que en cualquier evento la responsabilidad de PAQ, va a ser limitada a lo siguiente: (a) En el evento de perdida de documentos o cualquier tipo de papeles, ya sean escritos a maquina o a mano, sean personales o de negocios, incluyendo planos y fotografías hasta un máximo de USD 100.oo por despacho y proveerá transportación al mismo destino. (b) PAQ no será responsable 1) En ningún evento, por perdida, daños, entregas no posibles o retrasos que no hayan sido causados por negligencia de PAQ, de manera directa o indirecta con ocasión u omisión de terceros. 2 ) Por mercancías no aseguradas con PAQ. 3) Por presentar el remitente la mercancía a PAQ, con embalaje y/o empaques defectuosos o inadecuados para transporte modalidad tráfico postal y envíos urgentes. 4) Fuerza mayor o caso fortuito. (c) El límite de obligaciones asumidas por PAQ para envíos sin seguro , no excederá de USD 100.oo por despacho cuando los bienes o la mercancía, incluyendo muestras, son ofrecidas para cargamento. El remitente deberá solicitar a PAQ el seguro para obtener mayor cobertura. (d) Ninguna obligación es asumida por PAQ por el retraso en el despacho , o daños de cualquier tipo, como perdida de interés o perdida de cualquier oportunidad de negocios.

5. El remitente debe dar aviso de reclamo por escrito a PAQ con la fecha y la naturaleza del Reclamo dentro de un periodo de (15) días calendario contados a partir de la fecha de emisión de la cuenta de envío.

6. El remitente esta de acuerdo , que si es necesario por PAQ cualquier aclaración de aduana puede ser designada por PAQ a un agente de aduana. 7. El remitente es el principal responsable por cualquier y todos los cargos adicionales de un despacho normal incluyéndose el costo de regreso, si el despacho no es posible, o si hay que deshacerse de líquidos o materiales por las instrucciones del remitente. 8. El remitente manifiesta conocer las limitaciones contenidas en las leyes colombianas y en especial las del Estatuto Aduanero Decreto N. 2685 de Diciembre 28 de 1999 y normas Concordantes.

The following conditions are hereby made and agreed to between the shipper and PAQ EXPRESS hereinafter referred to as ¨PAQ¨ No agent employee of either party may alter these terms.

1. PAQ, subject to its scope of service and in consideration of payment in accordance with the rates set forth, agrees to transports the shipment to destination and in accordance with the instructions on this consignment bill. PAQ, reserves the right to use any route(s) and procedure(s) it deems necessary to complete the shipment.

2. PAQ reserves the right to refuse any shipment at its discretion and further, may reject a shipment at any time acceptance. Cash negotiable securities, hazardous materials goods, not acceptable for air transportation will not be accepted under any circumstances.

3. The shipper declares that the contents of the shipment do not include any of the items mentioned in paragraph 2, nor does it contain any items prohibited by law in any country or state, from, to or through which the items may be carried. PAQ and/or any official government representative may open and inspect the shipment.

4. Its agreed that the liability of PAQ will be limited, in any event, to the following: (a) In a event of lost or damage of documents or any type of papers, either typed, printed or handwritten either for personal or business use, including plans and photos, PAQ will pay the fair cost of duplicating the items up to a maximum of $100.00 per shipment and will provide free transportation one duplicated items to the same destination of direct or indirect way with occasion or omission of third. (b) PAQ will not be liable 1) in any event, for loss damage, misdelivery or delay not caused by PAQ own negligence. 2) Goods or merchandise not insured by PAQ. 3) Insufficient or improper packaging for courier transport. 4) act of God (c) When goods or merchandise, including samples, are tendered for carriage, the limit of PAQ liability will not exceed $100.00 per shipment, The shipper must request PAQ for additional coverage. (d) No liability is assumed by PAQ for delay in delivery or for consequential damages of any kind, such as loss of income, loss of interest or loss of business.

5. The shipper must give notice of claim to PAQ in writing, stating the date and nature of the claim whit in a period of 15 day from the date of issuance of the consignment bill.

6. The shipper agrees, that if found necessary by PAQ. Any required customs clearance can be designated by PAQ a licensed custom broker. 7. Not with standing any agreement to the contrary the shipper is primarily responsible for any and all additional charges, incidental to normal delivery including but not confined to the cost or return if undeliverable or disposal by shipper’s instructions. 8. The shipper declares that he knows the limitations under Colombian laws and specially on “Estatuto Aduanero Decreto N. 2685 de Diciembre 28 de 1999” and matching rules.
